MBA Asks Members for RESPA Feedback

The Mortgage Bankers Association today asked its members to comment on three draft segments for the MBA final proposal on RESPA reform to the U.S. Department of Housing and Urban Development. The draft segments included a proposed revision to the HUD-1 form as well as a proposed new good faith estimate (GFE).

If the current draft holds up, while the MBA would prefer that the market proceed as it has been in reforming itself, the organization will propose a three-tiered approach to any reform rulings issued by HUD.

Tier one includes changes to application and settlement forms, while subsequent tiers propose capping incremental fees. In tier two, the MBA would propose a 2 percent cap on any increase in broker fees from the time of application to settlement, while in tier three a similar cap of 10 percent would be imposed on title agencies and related third parties.
